1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of services provided by The Mentoring Lab Training and Development Ltd referred to as The Mentoring Lab ("we," "us," or "our"), including youth mentoring training courses, qualifications, consulting services, youth mentoring resources, and outreach youth mentoring services delivered at client locations.
By engaging our services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services.
2. Services
2.1 Youth Mentoring Training Courses and Qualifications
All course materials provided are the intellectual property of The Mentoring Lab. Course dates, times, and locations are subject to change with reasonable notice. We require minimum participant numbers for courses to proceed, and qualification requirements must be met in full for certification to be issued.
2.2 Consulting Services
Services will be delivered as outlined in the agreed proposal or contract. Additional services requested beyond the agreed scope may incur extra charges. We reserve the right to assign appropriately qualified staff to deliver consulting services.
2.3 Youth Mentoring Resources
Physical and digital resources remain the intellectual property of The Mentoring Lab. Resources are for personal or organisational use only and may not be reproduced, distributed, or resold without written permission.
2.4 Outreach Youth Mentoring
Services delivered at client locations are subject to appropriate venue arrangements by the client. We reserve the right to cancel or reschedule sessions if the venue is deemed unsuitable or unsafe. The client is responsible for ensuring appropriate safeguarding measures are in place for youth participants.
3. Booking and Registration
3.1 Training Courses and Qualifications
Course bookings are confirmed upon receipt of payment or purchase order. Early registration discounts, if offered, are subject to payment by the specified deadline. Group discounts are available as specified in our current pricing structure.
3.2 Consulting and Outreach Services
Services are confirmed upon signed agreement and receipt of any required deposit. Dates are secured on a first-come, first-served basis. Long-term service agreements may be subject to periodic review and adjustment.
4. Payment Terms
4.1 Fees and Charges
All fees are as stated at the time of booking or in the agreed proposal. Prices may be subject to change, but not for confirmed bookings. VAT or applicable taxes will be charged as per current legislation.
4.2 Payment Methods
We accept payment by bank transfer, credit/debit card, Klarna, or purchase order from approved organisations. Payment terms are strictly 30 days from invoice date unless otherwise agreed in writing. Late payments may incur interest charges at 4-8% above the Bank of England base rate.
4.3 Klarna Payments
When choosing Klarna as your payment method, you will be subject to Klarna's terms and conditions in addition to our own. By using Klarna's payment options, you agree to Klarna's data practices and allow us to share necessary information with Klarna to facilitate your payment.
Klarna offers various payment options which may include Pay in 30 days, Pay in 3 installments, or Financing. Each payment option has specific terms that will be presented to you at checkout. Eligibility for Klarna payment options is subject to Klarna's assessment of your financial circumstances and credit history.
For refunds on purchases made using Klarna:
The refund will be processed back to Klarna, who will handle the refund according to your specific payment arrangement.
For Pay in 30 days and instalment plans, Klarna will either reduce your balance or provide a refund to your original payment method.
For financing arrangements, Klarna will adjust your payment plan accordingly.
Processing times for Klarna refunds typically take 5-7 business days but may vary depending on your bank and payment arrangement.
4.4 Expenses
Travel, accommodation, and subsistence expenses for staff delivering services at client locations will be charged as agreed in advance. Itemised expense receipts will be provided upon request.
5. Cancellations and Rescheduling
5.1 By Clients
For training courses and qualifications, we offer a 100% refund for cancellations made 14 days or more before the training start date. Cancellations made between 7-14 days before the start date receive a 50% refund. No refund is available for cancellations made less than 7 days before the start date.
The same cancellation terms apply to consulting and outreach services: full refund with 14+ days' notice, 50% refund with 7-14 days' notice, and no refund with less than 7 days' notice.
Rescheduling requests will be accommodated where possible but may incur administrative fees.
5.2 By The Mentoring Lab
We reserve the right to cancel or reschedule services with reasonable notice. In the event of cancellation by us, a full refund or alternative dates will be offered. We are not liable for any consequential losses arising from cancelled services.
6. Intellectual Property
All materials, resources, methodologies, and content provided remain the exclusive property of The Mentoring Lab. Clients may use materials for their intended purpose only. Recording of training sessions is prohibited without prior written consent. Any intellectual property developed during consulting engagements will be owned as specified in the project agreement.
7. Confidentiality
We will treat all client information as confidential and will not disclose it to third parties without consent, except as required by law. Clients agree to maintain confidentiality regarding our proprietary methods, materials, and business information. Case studies featuring client work may be used for marketing purposes with prior written consent.
8. Data Protection
We comply with all applicable data protection regulations, including the UK Data Protection Act and GDPR. Personal data will be processed as outlined in our Privacy Policy. Client data will only be used for the purposes of delivering contracted services unless additional consent is obtained.
9. Safeguarding
We adhere to strict safeguarding policies when working with young people. All staff involved in youth mentoring have undergone appropriate background checks. Clients must provide appropriate supervision and safeguarding measures when services are delivered at their premises. Any safeguarding concerns must be reported immediately following our safeguarding procedures.
10. Quality Assurance
We are committed to delivering high-quality services that meet professional standards. Feedback is welcome and will be used to improve our services. Complaints will be handled in accordance with our Complaints Procedure, available upon request.
11. Liability and Insurance
The Mentoring Lab maintains appropriate professional indemnity and public liability insurance. Our liability is limited to the value of the services provided. We are not liable for indirect, special, or consequential damages. Clients are responsible for ensuring the safety and suitability of their premises for service delivery.
12. Force Majeure
Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, terrorism, government restrictions, or pandemic-related disruptions. Services affected by force majeure events will be rescheduled when practicable.
13. Termination
Either party may terminate ongoing service agreements with 30 days' written notice. We reserve the right to terminate services immediately in case of non-payment, breach of these Terms, or unethical conduct. Upon termination, all outstanding payments become immediately due.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of United Kingdom, Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of United Kingdom.
15. Amendments
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or direct notification to clients. Continued use of our services after changes constitute acceptance of the modified Terms.
